These Terms apply to all users, including property developers, agents, brokers, and potential buyers or renters.

  1. Definitions

    Unless otherwise specified words shall have the meanings as defined herein below:

    • “SuGanta”: Refers to the company providing the services through SuGanta’s platform, including the website, mobile applications, and other tools.
    • “User”: Refers to any individual or entity using SuGanta’s platform, including property owners, developers, brokers, agents, and buyers or renters.
    • “Platform”: Refers to SuGanta’s website, mobile applications, and other related digital services.
    • SuGanta Reality LLP is defined as the internet website of the company at www.SuGanta.com.
    • “Services”: Includes all functionalities, listings, advertisements, marketing campaigns, and resources offered through SuGanta.
  2. Submission and Administration of Listings/Advertisements

    By submitting a property listing or advertisement on SuGanta, users represent that all information provided is accurate, current, and complete. SuGanta reserves the right to review, modify, reject, or remove any listings or advertisements that do not comply with the platform’s standards. Property owners and agents are responsible for maintaining the accuracy of their listings and updating them regularly.

    • Payment Terms: For paid listings and advertisements, payment must be made in full and in advance according to the service plan selected. SuGanta offers various subscription and advertising plans, and users are responsible for selecting the appropriate plan based on their needs. Failure to make timely payments may result in the removal or suspension of the listings or advertisements without prior notice.
    • Refund in Failed Transactions : In case of a failed transaction due to technical issues or errors, users are entitled to a full refund after verification. SuGanta will process the refund within 7-10 business days upon confirmation of the failed transaction. However, SuGanta reserves the right to investigate the circumstances of the failed transaction before issuing the refund.
  3. CPL Marketing Campaigns with Developers and Agents/Brokers

    SuGanta may engage in CPL (Cost Per Lead) marketing campaigns in partnership with developers, agents, and brokers. These campaigns are designed to generate leads for property listings. All parties participating in CPL campaigns must comply with the specific terms agreed upon in separate contracts. SuGanta will manage and track the campaigns, ensuring transparency and compliance with applicable laws.

  4. Video Community Guidelines

    Users may upload videos related to their property listings on SuGanta. However, all video content must adhere to SuGanta’s community guidelines. Offensive, misleading, or inappropriate content is strictly prohibited. Videos must accurately represent the properties or services being advertised. SuGanta reserves the right to remove any videos that violate these guidelines and may suspend or terminate accounts for repeated violations.

  5. Use of Information

    SuGanta collects, stores, and uses the information provided by users in accordance with its Privacy Policy. By using the platform, you consent to the collection and use of your information for the purposes of providing services, improving user experience, and enhancing platform functionality. Users are responsible for ensuring the accuracy and completeness of the information they provide. SuGanta may share information with third parties as necessary for service delivery, but only in accordance with the Privacy Policy.

  6. Intellectual Property Rights

    All content available on SuGanta’s platform, including text, images, videos, graphics, and software, is the intellectual property of SuGanta or its licensors. Property owners and agents grant SuGanta a non-exclusive license to use their content for promotional and marketing purposes on the platform.

  7. Restrictions/Prohibitions

    Users are strictly prohibited from engaging in the following activities on SuGanta:

    • Providing false or misleading information in listings or advertisements.
    • Uploading malicious code, viruses, or any content that could harm the platform or its users.
    • Engaging in illegal activities through the platform, including fraudulent transactions or spamming.
    • Misusing SuGanta’s services for unauthorized marketing or soliciting purposes.

    SuGanta’s platform may include links to third-party websites for the convenience of users. However, SuGanta is not responsible for the content, accuracy, or reliability of such third-party websites. Users access these websites at their own risk, and SuGanta's Terms do not apply to the external sites. Users may terminate their accounts by providing written notice to SuGanta, but they remain responsible for any fees or obligations accrued before termination.

    • Terms of Conditions Specific for Dealers/Builders/Banks/Payment Gateways: Dealers, builders, banks, and payment gateways using SuGanta’s platform are subject to additional terms and agreements. These agreements govern their use of the platform for promoting properties, conducting financial transactions, and processing payments. SuGanta requires these entities to comply with legal and regulatory standards related to real estate transactions and financial services.
  14. Arbitration

    In the event of a dispute arising from or relating to these Terms, the parties agree to resolve the matter through binding arbitration.
